Defective Products Sold by Amazon: Amazon is the world’s largest retailer of consumer products in the world. Unfortunately, some items for sale on Amazon are not safe and have caused serious injuries. Many of these products are made in China. Seeking redress against Chinese manufacturers is extremely difficult if not impossible. Amazon claims that it is only a service provider which lists the products of other sellers on its e-commerce platform and that it is not responsible for injuries from defective products. Even so, Amazon instituted its A to Z Claims Process through which it seeks to settle consumer claims for up to $1,000.00. In 2020, Bolger v. Amazon.com, LLC, 53 Cal. App. 5th 431, 267 Cal. Rptr.3d 601 (Cal. The Court found that the battery had been stored in Amazon’s warehouse, that Amazon received payment for the battery, that Amazon shipped the battery, that the terms of Amazon’s relationship with the seller was established by Amazon, and that Amazon charged fees on the battery. On July 30, 2024, the US Consumer Product Safety Commission determined that Amazon is a distributor of any defective products which it lists for sale, and that Amazon bears legal responsibility for the recall of those defective products. If you are injured by a defective product purchased through Amazon, document the injury with photos. Print out the Amazon listing before it is removed. The listing may show the seller and/or the supplier. On the listing, leave a review about your experience. Report the problem to Amazon. Report the defective product to the US Consumer Product Safety Commission at www.saferproducts.gov.
